Terms and Conditions
1. Who we are
This website, anemexclusives.com, is operated by Anem Exclusives Ltd, a company registered in England and Wales under company number 13413799. Our VAT number is GB469149942. For questions about an order or these terms, email sales@anemexclusives.com.
These terms apply to purchases made through our website and to your use of the website. Our Delivery Policy, Privacy Policy and Cookie Policy provide more detail about those subjects. If we agree separate written terms for a trade order, those terms also apply to that order. Nothing in these terms takes away rights that cannot be excluded by law.
2. Consumer and trade customers
We supply both consumers and trade customers. You are a consumer if you buy goods wholly or mainly for your personal use and not wholly or mainly for use in your trade, business, craft or profession. A trade customer buys wholly or mainly for business purposes. If you place an order on behalf of a business, you confirm that you have authority to do so.
The consumer cancellation rights in section 9 apply only to consumers. Trade customers should read section 11, including our rule on change-of-mind returns.
3. Using our website and your account
You may browse, register, place orders and contact us for lawful purposes. Please give accurate contact, billing and delivery details and keep them up to date. If you have an account, keep your login details confidential and contact us promptly if you suspect unauthorised access.
Do not try to gain unauthorised access to the website, disrupt its operation, introduce malicious code, misuse its forms or use its content in a way that infringes another person’s rights. We may temporarily restrict access when reasonably needed to maintain or protect the website. This does not affect an order we have already accepted or any rights you have by law.
The content and design we create for the website belong to us or are used with permission. Product names, logos and images may belong to their respective owners. You may view or print pages for your own shopping or internal business purchasing. Please obtain the relevant owner’s permission before republishing or commercially reusing website content.
4. Products and availability
We aim to describe goods accurately, including their main features, quantity and any important limitations. Please check the product description and pack size before ordering. Images illustrate the goods; packaging or colour may vary, but the goods supplied must meet their description and any applicable legal standards.
All orders depend on availability. A product shown on the website is not a promise that it will remain in stock. If we cannot supply an item, or discover a material error in its description or price, we will contact you. We will not substitute a materially different item without your agreement. If we cannot fulfil an accepted order, we will refund the affected amount and any delivery charge that no longer applies.
5. Prices, VAT and delivery charges
Prices shown for trade customers may be stated excluding VAT when clearly identified as trade prices. Applicable VAT is added to those prices. The total amount payable, including applicable VAT and any delivery charge, must be shown before you confirm and pay for an order. Delivery options and charges depend on the order and destination and are displayed during checkout.
We may change prices before an order is accepted. A later price change does not alter a contract already formed. If there is an obvious pricing or listing error, we may decline to accept the affected order and will explain the correct price so that you can decide whether to place a new order. If we have taken payment for goods we cannot supply, we will refund it.
6. Placing an order and forming a contract
Please review your basket, quantities, delivery address, delivery option and total before submitting your order. An automatic order acknowledgement confirms that we have received your request; it does not necessarily mean that we have accepted it. A contract is formed when we confirm that we have accepted your order or confirm that it has been dispatched, whichever happens first.
We may be unable to accept an order if goods are unavailable, payment is not authorised, delivery cannot be arranged, the listing contains a material error, or we reasonably suspect misuse or fraud. We will contact you where practical and refund any payment for an order we do not accept. Please email sales@anemexclusives.com promptly if you need to request a change or cancellation before dispatch. We will try to help, but a change cannot be guaranteed once processing or dispatch has begun. Consumer cancellation rights after delivery are set out below.
7. Payment
Online card payments are processed through Stripe. The payment methods actually available for an order are shown at checkout. Payment must be authorised when you order unless we have expressly agreed different terms in writing. A request for trade pricing does not by itself create a credit account or a right to pay later.
If a payment fails, we may ask you to use another available payment method before we accept or dispatch the order. Please do not email us your full card details.
8. Delivery
We deliver to addresses in the United Kingdom. For products in stock, our usual estimated delivery time is 1–2 days. Next-day delivery is available where offered for the particular order and destination. The service shown at checkout, stock position, order timing and destination can affect the actual date. Our Delivery Policy explains delivery options, charges, delays and problems with a parcel.
We will deliver by any agreed date or period. For a consumer order, if no delivery period is agreed, we will deliver without undue delay and within the period required by law. If delivery is late, contact us so we can investigate and explain your options. We are responsible for goods bought by a consumer until they reach the consumer or a person the consumer has nominated, subject to the legal rules if the consumer independently arranges a carrier.
9. Consumer cancellation when you change your mind
If you bought online as a consumer, you normally have a legal right to cancel without giving a reason. You may notify us from the time the contract is made until 14 days after the day you receive the goods. If one order is delivered in separate parcels, the period normally runs until 14 days after you receive the last item. Certain goods are excluded by law, as described below.
To cancel, email sales@anemexclusives.com with your name, order number and a clear statement that you are cancelling. You may use the model form at the end of this page, but you do not have to. Contacting us before you send goods back helps us identify the return.
Once you have told us you are cancelling, send the goods to the returns address in section 12 within 14 days. You are responsible for the direct cost of returning goods when cancelling because you have changed your mind. Please use suitable packaging and keep proof of postage. You may inspect goods as you would in a shop; we may reduce the refund to reflect loss of value caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
We will refund the price paid for the cancelled goods. If you cancel the whole order, we will also refund the cost of our least expensive standard delivery option offered for that order, where you paid for delivery. We do not have to refund the extra cost of a premium service you chose. We will use your original payment method unless you expressly agree otherwise. We may wait until we receive the goods or evidence that you have sent them, whichever is earlier, and will then refund without undue delay and no later than 14 days after that point. If no goods were supplied, the refund deadline is 14 days from when you told us you were cancelling.
The legal right to cancel does not apply to every type of goods. Examples can include goods made to your specifications, goods liable to deteriorate rapidly, and sealed goods unsuitable for return for health or hygiene reasons once the seal is broken. An exception applies only where the law permits it. Your rights if goods are faulty, damaged or misdescribed remain in place.
10. Faulty, damaged, incorrect or missing goods
Please email sales@anemexclusives.com with your order number and an explanation if an item is faulty, damaged, incorrect or missing, or if a parcel does not arrive. Photographs can help us investigate damage, but they are not a condition of your statutory rights. You do not need original packaging to exercise rights relating to faulty goods.
Consumers have legal rights to goods that are as described, fit for purpose and of satisfactory quality. These may include a short-term right to reject within 30 days of delivery and, where appropriate, a repair, replacement, price reduction or refund later. We will arrange an appropriate remedy in line with those rights. If goods are faulty or we sent the wrong item, we will provide return instructions and cover reasonable return costs where required. Please contact us even if you discover a problem after the initial 30 days.
Reporting damage or shortages promptly helps us investigate with the carrier, but there is no 48-hour reporting cut-off for a consumer’s statutory rights. If a product is recalled, follow the instructions we send you and contact us for help.
11. Trade orders and returns
The consumer change-of-mind cancellation right in section 9 does not apply to orders made wholly or mainly for business purposes. We do not accept change-of-mind returns from trade buyers. Please inspect a trade delivery and tell us promptly if goods are damaged, incomplete, incorrect or faulty so that we can investigate and discuss a remedy. This policy does not remove any trade remedy that cannot lawfully be excluded.
Unless we agree otherwise in writing, ownership of goods supplied to a trade customer passes when we have received payment in full. Any specially agreed trade price, credit term or separate supply arrangement must be confirmed by us in writing.
12. Returns address and contact
Please send returns to:
Anem Exclusives – Returns
Unit 356 (Entrance 3)
272 Kings Road
Tyseley, Birmingham B11 2AB
United Kingdom
Include your order number or a note identifying the order. For a faulty, damaged or incorrect item, email us before posting so we can provide the appropriate instructions.
For order questions or complaints, email sales@anemexclusives.com. We will consider the details and respond as soon as reasonably possible.
13. Responsibility, events outside our control and changes
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing restricts a consumer’s statutory rights. We are not responsible for a delay caused by an event outside our reasonable control while that event continues, but we will contact you where practical and take reasonable steps to reduce the delay. Your legal rights concerning late delivery remain available.
We may update these terms for future orders. The version that applies to an order is generally the version in force when the contract for that order is formed. If one part of these terms is unenforceable, the rest continues to apply. The law of England and Wales governs these terms, subject to any mandatory consumer protections and court rights that apply where you live.
14. Model cancellation form
Complete and return this form only if you wish to cancel your contract.
